DOJ warns Robin Padilla may waive defense rights if he skips probe

PHILIPPINES – Senator Robin Padilla could waive his right to present a defense if he fails to attend next week’s preliminary investigation into the obstruction of justice complaint filed against him over his alleged role in helping Senator Ronald “Bato” Dela Rosa evade arrest.

DOJ Undersecretary Ian Dato said Padilla’s failure to appear would allow prosecutors to resolve the case based on the evidence already on record. The preliminary investigation is scheduled to give Padilla an opportunity to answer the allegations and submit his counter-affidavit and supporting evidence.

Dato stressed, however, that the issuance of a subpoena does not mean Padilla has been found guilty. He said the proceedings remain at the preliminary investigation stage, where prosecutors will determine whether there is sufficient basis to establish a prima facie case.

The complaint stems from the May 14 attempt to arrest Dela Rosa over an International Criminal Court warrant related to alleged crimes against humanity connected to former President Rodrigo Duterte’s anti-drug campaign.

Dela Rosa, who served as Philippine National Police chief under Duterte, was inside the Senate when authorities attempted to serve the warrant. Padilla later acknowledged that Dela Rosa rode with him when leaving the Senate building as law enforcement officers were trying to arrest him.

The DOJ said the subpoena is part of the standard procedure whenever a complaint is filed, giving respondents the opportunity to respond before prosecutors make a determination on the case.

The upcoming preliminary investigation will therefore give Padilla a formal opportunity to address the allegations and present his evidence, while prosecutors assess whether the complaint has sufficient basis to proceed.
