Alberta referendum puts federal funding and provincial control on the ballot

CANADA – Alberta’s October 19 referendum will ask voters to weigh in on more than separation and immigration, with one of the constitutional questions targeting Ottawa’s control over federal funding for provincial programs.

The proposed change would allow provinces to opt out of federal programs in areas such as health care, education and social services while keeping the associated federal funding for their own social programs.

Constitutional law experts are divided over the proposal. UBC constitutional law scholar Geoffrey Sigalet said Alberta is seeking to limit Ottawa’s constitutional spending power, while University of Toronto law professor David Schneiderman argued that provinces can already reject federal funding when they disagree with the conditions attached.

The debate is not new. A similar proposal was included in the Meech Lake Accord in the 1980s, which would have allowed provinces to opt out of certain federal programs with reasonable compensation, provided they established programs compatible with national objectives.

Alberta’s proposal goes further by not specifying the same requirement, raising questions over how an opt-out system would work and whether Ottawa would agree to such an arrangement.

Even if Albertans vote yes, the change would not take effect immediately. Any constitutional amendment would require approval from Parliament and at least seven provinces representing at least half of Canada’s population.

The referendum therefore sets the stage for a much larger debate over who controls public programs, who controls the money behind them and how far provincial autonomy can extend within Canada’s federal system.
