DOJ OKs drug raps vs Korean-American drug supplier

MANILA–The Department of Justice (DoJ) on Monday approved the drug trafficking charges filed by Philippine National Police (PNP) against a Korean-American drug supplier who escaped from hospital detention last April 15.

The DOJ said that case for violation of the Comprehensive Dangerous Drugs Act of 2002 has been filed before the Pasay City Regional Trial Court after Philippine National Police Drug Enforcement Group seized 140 ecstasy tablets to Jun No.

No, who was apprehended last April 5 at the parking lot of a restaurant in the Mall of Asia Complex in Pasay City for selling 140 tablets of Ecstasy to an undercover agent.

The PNP-DEG said the drugs seized from No had an estimated value of PHP420, 000.

“Evidence presented by complainant PNP-DEG clearly established that respondent illegally transacted that is sold the 140 tablets of ecstacy in a buy-bust operation. Further, recovered from the respondent are the boodle money used in the operation,” the DOJ resolution stated dated April 7 prepared by Assistant State Prosecutor Noel Antay Jr. and and was approved by Prosecutor General Victor Sepulveda.

The complaint said examination conducted by the PDEA Laboratory Service revealed that the suspected Ecstasy tablets recovered from No yielded positive results for the presence of methylene dioxymethamphetamine or MMA, which is considered a dangerous drugs.

The resolution said they found the elements needed to sustain a case of selling illegal drugs against No namely,” the identity of the buyer, as well as the seller, the object and consideration of the sale, and the delivery of the thing sold and the payment thereafter.”

The DOJ is also set to hold another preliminary investigation on No for the sale of two Ecstasy tablets to Aguilan on April 2 in Malate, Manila that the PNP-DEG used to confirm his illegal activities before conducting the April 5 operation that led to his arrest.

No escaped last April 15 from the East Avenue Medical Center in Quezon City after undergoing an operation for acute appendicitis.

His security escorts-SPO2 Michael Macarubbo of the PNP-DEG and Intelligence Officer 2 Ernie Eugenio of the Philippine Drug Enforcement Agency-were charged with evasion through negligence for his escape.

The Quezon City Prosecutors Office found probable cause to charge Macarubbo and Eugenio and recommended bail at PHP6,000 each.

The two were also slapped with an administrative complaint for serious neglect of duty.
