Lacson pushes harsher penalties for those who pressure witnesses to lie

Senator Panfilo Lacson is seeking tougher penalties against individuals who coerce or induce witnesses to commit perjury, following the recent recantation of Orly Guteza and members of the so-called “Maleta Boys” in allegations involving former House Speaker Martin Romualdez and other officials.

Lacson said the recantations should trigger stricter enforcement of the Anti-Perjury Law, warning that false testimonies and subsequent withdrawals could become a “lucrative business,” particularly in cases involving political figures.

He noted that Republic Act No. 11594, enacted in 2021, already raised the penalty for perjury to prision mayor, or six years and one day to 12 years in prison. Those who induce another person to commit perjury may also be held liable as principals by inducement.

Lacson said he plans to file a bill imposing even heavier penalties and fines for those who force, pressure or persuade others to give false testimony.

He also stressed that the recent recantations do not automatically weaken the cases against those implicated, as authorities must still assess the evidence and determine the credibility of the witnesses involved.

Guteza, a retired Marine and former security aide of fugitive ex-Ako Bicol Rep. Zaldy Co, previously claimed that he delivered suitcases containing cash to Romualdez in connection with an alleged flood control kickback scheme.

In an Aug. 13 affidavit, however, Guteza withdrew his testimony and alleged that Senator Rodante Marcoleta and former lawmaker Mike Defensor pressured him to implicate Romualdez.

For Lacson, the issue goes beyond one witness or one case: those who manufacture testimony must face consequences if they are found to have manipulated the justice system.
