No deadline extension for SOCE filing – Comelec

MANILA – The Commission on Elections (Comelec) on Wednesday said the June 11 deadline for the filing of Statements of Contributions and Expenditures (SOCEs) of candidates in the May 12 midterm elections will not be extended.

According to Comelec spokesperson John Rex Laudiangco, national and local candidates, as well as political parties and party-list organizations, have until the middle of next month to submit their SOCEs, which is required under Republic Act (RA) No. 7166.

“They need to file their SOCEs within 30 days after the elections, or until June 11. There will be no extensions,” he said in a press briefing at the Tent City of the Manila Hotel, where the national votes are being canvassed by the Comelec en banc sitting as the National Board of Canvassers.

“The Supreme Court has ruled several times that the Comelec has no power to change the deadline as it is provided for by the law,” Laudiangco added.

The Comelec official also reminded winning candidates that they cannot assume their posts if they fail to file their SOCEs.

“Even if you have taken your oath of office, you cannot assume office until you have proof of submitting your SOCE,” Laudiangco said.

He warned both winning and losing candidates that failure to submit their SOCEs may result in the filing of an administrative case.

“Their failure to file SOCE may result to fines for the first offense. For the 2nd time, it can result to perpetual disqualification,” Laudiangco said.

Candidates and political organizations may submit their SOCEs in the Comelec offices where they filed their Certificates of Candidacy (COCs).

RA No. 7166 requires a candidate and political party, within 30 days after the day of the election, to file in duplicate the “full, true, and itemized” statement of all contributions and expenditures in connection with the election.
