DOJ orders filing of criminal raps vs. alleged mastermind in Pastor slay

MANILA — The Department of Justice (DOJ) ordered on Monday the filing of a complaint for illegal possession of firearms against the alleged mastermind in the killing of car racer Ferdinand “Enzo” Pastor.

In a seven-page resolution approved by Prosecutor General Claro A. Arellano, the DOJ recommended that Domingo de Guzman III be charged in court for violation of Republic Act No.

10591 or illegal possession of firearms and ammunition.

However, the complaint for murder and frustrated murder, which are both for violation of Articles 248 and 250 of the Revised Penal Code (RPC), against Domingo was ordered to undergo preliminary investigation, as well as the case of parricide and frustrated murder against Pastor’s wife, Dahlia Guerrero who was allegedly a conspirator in the planning of the crime.

This was because the “inquest period” for the complaint of murder, frustrated murder and parricide against De Guzman and Dahlia has already lapsed since the killing of Pastor took place last June 12 or more than two months ago.

The preliminary investigation against De Guzman and Dahlia was set on Sept. 9 and 16, 2014.

Meanwhile, respondent Police Officer 2 Edgar Angel, who admitted in an extrajudicial confession that he shot to death Pastor, was ordered to submit his counter-affidavit on Sept. 2, 2014 after he signed a waiver stating that he voluntarily surrendered his right under Article 125 of the RPC, or “Delay in the Delivery to Judicial Authorities.”

Angel was arrested in a “buy-bust” operation in Quezon City last Aug. 23 wherein he was caught in the act of selling 100 grams of suspected shabu.

On the other hand, De Guzman was arrested in an entrapment operation last Aug. 26 in Sto. Nino Village, Muntinlupa City. Seized from his possession were two firearms loaded with ammunition.
