MANILA — The camp of former Cadet First Class Aldrin Cudia on Monday maintained that he should be included in the list of graduates of the Philippine Military Academy (PMA) “Siklab Diwa” Class of 2014.

This was through the reply filed by Cudia on the comment of the Office of the Solicitor General (OSG) in the petition he filed before the Supreme Court (SC).

Cudia argued that “grave abuse of discretion” was committed on the part of the PMA when he was not allowed to graduate from the academy because he was caught “late for two minutes” in the class.

He also argued that he was denied “due process” by the PMA.

Cudia believes that his non-inclusion in the graduation ceremony of the PMA can only be considered as “moot and academic”, but not the “merit” of his case.

For her part, Public Attorney’s Office (PAO) Chief Atty. Persida Rueda-Acosta, who is defending the case of Cudia, said that there is the so-called “judicial supremacy” in similar cases of abuse and violation of human rights by some officials of the PMA.

Acosta added that it was contrary to the position of the OSG that the case of Cudia is not under the jurisdiction of the SC.
