Sara Duterte impeachment trial moves forward as Senate wrestles with the numbers

PHILIPPINES – The impeachment trial of Vice President Sara Duterte is moving forward, but a debate over a seemingly simple question is adding another layer of uncertainty to the proceedings, how many votes are actually needed to convict.

The Senate impeachment court has maintained that 16 votes are required for conviction, based on two-thirds of the full 24-member Senate. But with only 20 senator-judges currently able to participate, questions have emerged over whether the threshold should instead be based on the active members of the court.

The dispute has now become a legal and procedural battle of its own. Senate impeachment court spokesperson Reginald Tongol clarified that 11 votes would be needed to overturn the ruling setting the 16-vote threshold.

That means the trial will continue while the Senate wrestles with the rules that could ultimately determine how the verdict is decided.

For Duterte’s camp, changing the threshold could significantly alter the political and legal stakes of the proceedings. For the impeachment court, however, the immediate challenge is to settle the rules while keeping the trial moving.

The debate highlights how much more than evidence is at stake in the impeachment proceedings. The numbers themselves have become part of the battle, with the composition of the Senate, constitutional interpretation and voting rules potentially shaping the final outcome.

As the trial continues, senator-judges are therefore confronting two questions at once: the allegations against the Vice President and the rules that will determine what number is enough to decide her political fate.
