{"id":91640,"date":"2017-02-28T05:23:04","date_gmt":"2017-02-28T10:23:04","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=91640"},"modified":"2017-02-28T05:23:04","modified_gmt":"2017-02-28T10:23:04","slug":"de-limas-legal-team-appeals-to-the-sc","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2017\/02\/28\/de-limas-legal-team-appeals-to-the-sc\/","title":{"rendered":"De Lima\u2019s legal team appeals to the SC"},"content":{"rendered":"<figure id=\"attachment_91641\" aria-describedby=\"caption-attachment-91641\" style=\"width: 300px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-91641\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o-300x300.jpg\" alt=\"Photo: Leila De Lima\/Facebook.com\" width=\"300\" height=\"300\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o-300x300.jpg 300w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o-150x150.jpg 150w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o-768x768.jpg 768w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o-1024x1024.jpg 1024w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/02\/14195931_1849176635312883_2667080816394628382_o.jpg 1365w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-91641\" class=\"wp-caption-text\">Photo: Leila De Lima\/Facebook.com<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400\">De Lima\u2019s defense team filed an 82-page petition for certiorari urging the Supreme Court to free the senator.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The team filed a request to issue a status quo ante order and a temporary restraining order preventing Executive Judge Juanita Guerrero of the Muntinlupa City Trial Court Branch 204 from hearing her case.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The petition also included accusations that Guerrero had prejudged the case and committed grave abuse of discretion for issuing the arrest warrant with \u201cundue haste and inordinate interest\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Alex Padilla, one of De Lima\u2019s lawyers, pointed out the inconsistency and the lack of due process in De Lima\u2019s case.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIf they can do this to a senator, how much more to (ordinary) citizens like us?\u201d he said in a news briefing before the petition was filed. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe issuance of a warrant of arrest by a court that has no jurisdiction over the case makes such warrant obviously and patently null and without basis, thus making Senator De Lima\u2019s detention \u2026 illegal,\u201d Padilla added.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The defense petition also argued that the RTC has no jurisdiction over De Lima due to her status as a public official and that her case must be handled by the Office of the Ombudsman and the Sandiganbayan since she is being charged a graft and corruption case.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In response, the Department of Justice created a 52-page resolution indicting De Lima and specified that she is being accused of trafficking drugs in the New Bilibid Prisons. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The resolution cited testimonies by high-profile convicts about how the national penitentiary had turned into a \u201cLittle Las Vegas\u201d and how they were able to create a multibillion-peso drug trade to fund De Lima\u2019s senatorial campaign. It has been cited that payoffs ranged from P50,000 to P5 million and was transferred through Ronnie Dayan who was De Lima\u2019s driver and lover, and Bureau of Corrections officer-in-charge Rafael Ragos. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The DOJ also contended that criminal courts have jurisdiction over drug cases and cited Supreme Court rulings such as the Liwag vs. DOJ decided in 2005 where the ruling states that \u201cthe agency who first takes cognizance of the complaint shall exercise jurisdiction to the exclusion of others\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The DOJ also cited the event when a Pasay RTC handled the election sabotage case of former President, Gloria Macapagal-Arroyo and the court acted hours after documentation has been presented declared the presence of probable cause to prosecute Arroyo.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Supreme Court had set oral arguments on March 14.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>De Lima\u2019s defense team filed an 82-page petition for certiorari urging the Supreme Court to free the senator.
