{"id":82135,"date":"2016-10-14T18:04:18","date_gmt":"2016-10-14T22:04:18","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=82135"},"modified":"2016-10-14T18:04:18","modified_gmt":"2016-10-14T22:04:18","slug":"montreal-seeks-right-appeal-ruling-suspended-pit-bull-related-measures","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2016\/10\/14\/montreal-seeks-right-appeal-ruling-suspended-pit-bull-related-measures\/","title":{"rendered":"Montreal seeks right to appeal ruling that suspended pit bull related measures"},"content":{"rendered":"<p><figure id=\"attachment_82136\" aria-describedby=\"caption-attachment-82136\" style=\"width: 1000px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2016\/10\/pit-bull.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2016\/10\/pit-bull.jpg\" alt=\"Pit Bull\" width=\"1000\" height=\"667\" class=\"size-full wp-image-82136\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2016\/10\/pit-bull.jpg 1000w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2016\/10\/pit-bull-300x200.jpg 300w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2016\/10\/pit-bull-768x512.jpg 768w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/a><figcaption id=\"caption-attachment-82136\" class=\"wp-caption-text\">Shutterstock<\/figcaption><\/figure><br \/>\n<strong>MONTREAL &#8211;<\/strong> Quebec&#8217;s highest court will rule whether Montreal can appeal a lower court decision that put its controversial pit bull measures on ice pending a legal challenge.<\/p>\n<p>Lawyers for the city appeared in the Court of Appeal on Friday and argued the pit bull rules are in the public interest.<\/p>\n<p>Montreal even seemed willing to make some concessions: a city lawyer promised no pit bulls would be euthanized until the legal challenge is fully heard &#8211; something that could take several months.<\/p>\n<p>Justice Manon Savard will deliberate before ruling at a later date, but suggested the city and the SPCA, which is challenging the law, should talk.<\/p>\n<p>On Friday, city lawyer Claude Marseille argued some measures should stand, including mandatory outdoor muzzling, leash restrictions and special licences.<\/p>\n<p>Marseille said the bylaw provisions neither constitute a &#8220;mistreatment&#8221; of pit bulls nor creates an irreparable prejudice to owners and he told the court the SPCA&#8217;s concerns aren&#8217;t enough to warrant a suspension.<\/p>\n<p>SPCA lawyers countered the stay they were granted is necessary because, they say, parts of the bylaw are discriminatory, unreasonable and penalize all pit bulls regardless of their behaviour.<\/p>\n<p>The SPCA&#8217;s Sophie Gaillard was surprised by the city&#8217;s apparent attempt at an olive branch. Following the hearing, she said the euthanasia ban alone wouldn&#8217;t be sufficient if the dogs could not be put up for adoption.<\/p>\n<p>Gaillard said the SPCA has limited shelter capacity and can&#8217;t house dogs indefinitely.<\/p>\n<p>&#8220;At this stage of the game, (the city) is suddenly saying that they&#8217;re willing perhaps to make certain concessions when we&#8217;ve been trying to meet with them to see if we can come to some sort of compromise on this since they first announced the bylaw in June,&#8221; Gaillard said.<\/p>\n<p>&#8220;We&#8217;ll consider what they have to offer, but one thing is for sure: our position is that healthy, adoptable, behaviourally sound dogs that present no danger should not be euthanized and we won&#8217;t be the ones to do it.&#8221;<\/p>\n<p>Quebec Superior Court Justice Louis J.
