{"id":66490,"date":"2015-12-07T05:04:50","date_gmt":"2015-12-07T10:04:50","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=66490"},"modified":"2015-12-07T05:04:50","modified_gmt":"2015-12-07T10:04:50","slug":"comelec-junks-petition-to-declare-martin-dino-as-nuisance-candidate","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2015\/12\/07\/comelec-junks-petition-to-declare-martin-dino-as-nuisance-candidate\/","title":{"rendered":"Comelec junks petition to declare Martin Di\u00f1o as nuisance candidate"},"content":{"rendered":"<p><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2015\/12\/placeholdr.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-66492\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2015\/12\/placeholdr.jpg\" alt=\"placeholdr\" width=\"1024\" height=\"768\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2015\/12\/placeholdr.jpg 1024w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2015\/12\/placeholdr-300x225.jpg 300w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p>MANILA, (PNA)\u2014The petition to declare Martin Di\u00f1o, former presidential candidate of the PDP-Laban as nuisance candidate has been junked by the Commission on Election (Comelec) for being moot and academic since he already withdrew his Certificate of Candidacy (CoC).<\/p>\n<p>\u201cWith the foregoing development, the relief prayed for in the present petition has become moot and academic, that is, whatever judgment is reached can no longer have any practical legal effect or, in the nature of things, can no longer be enforced,\u201d said the Comelec Second Division in a five-page decision.<\/p>\n<p>Earlier, the Comelec Law Department filed a moth proprio petition to Declare a Candidate as a Nuisance Candidate against Di\u00f1o.<\/p>\n<p>The December 4 ruling added, \u201cWherefore, premises considered, the petition to declare Martin Di\u00f1o as a nuisance candidate is hereby dismissed for being moot and academic.\u201d<\/p>\n<p>But, the Comelec Second Division noted that the decision is without prejudice to questions on whether Di\u00f1o\u2019s CoC was validly filed last October 16.<\/p>\n<p>\u201c(This is) without prejudice to any future ruling on the validity of the said COC\u2014formal or substantial\u2014that may be raised before the Commission,\u201d the ruling said.<\/p>\n<p>There is a pending petition filed by Ruben Castor before the Comelec First Division asking to declare Di\u00f1o\u2019s CoC as invalid and therefore, Davao City Mayor Rodrigo Duterte cannot substitute for Di\u00f1o since the latter applied to run for mayor of Pasay City and &#8220;not for president.&#8221;<\/p>\n<p>On the other hand, Comelec Chairman Juan Andres Bautista said that the Comelec First Division is set to hear Castor\u2019s petition on December 16.<\/p>\n<p>Duterte filed his CoC for president as a substitute for Di\u00f1o last November 27.
