{"id":27672,"date":"2014-10-02T14:49:42","date_gmt":"2014-10-02T06:49:42","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=27672"},"modified":"2014-10-02T11:10:40","modified_gmt":"2014-10-02T03:10:40","slug":"winnipeg-court-told-accused-in-murder-case-has-mental-capacity-of-small-child","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2014\/10\/02\/winnipeg-court-told-accused-in-murder-case-has-mental-capacity-of-small-child\/","title":{"rendered":"Winnipeg court told accused in murder case has mental capacity of small child"},"content":{"rendered":"<p><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2014\/09\/shutterstock_107145812.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-24788\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2014\/09\/shutterstock_107145812.jpg\" alt=\"shutterstock_107145812\" width=\"1000\" height=\"752\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2014\/09\/shutterstock_107145812.jpg 1000w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2014\/09\/shutterstock_107145812-300x225.jpg 300w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><\/a><\/p>\n<p>WINNIPEG\u2014A psychologist says a man accused of murder has the intellectual capacity of a small child.<\/p>\n<p>Dr. Kent Somers was testifying at the trial of 21-year-old Adam Monias.<\/p>\n<p>He\u2019s charged, along with his older brother Stephen, with second-degree murder in the 2012 stabbing death of their cousin, Ian Folster.<\/p>\n<p>The Crown contends the brothers beat and stabbed Folster to death because he laughed when another brother of the Monias\u2019 was arrested.<\/p>\n<p>On Wednesday, court was told Somers administered a battery of cognitive tests on Monias after he was incarcerated and said they indicated he was functionally illiterate and had the intellectual level of a 10-year-old.<\/p>\n<p>That testimony, coupled with evidence from an expert on fetal alcohol spectrum disorder, could lay the foundation for Monias\u2019 defence lawyers to argue he couldn\u2019t form the intent necessary for a murder conviction which could result in a conviction on a lesser offence like manslaughter.<\/p>\n<p>It\u2019s still unclear what legal defence his brother will mount.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>WINNIPEG\u2014A psychologist says a man accused of murder has the intellectual capacity of a small child.
