Photo courtesy of DGR Law Offices.<\/figcaption><\/figure>\n<p>MANILA \u2013 The Sandiganbayan was asked to withdraw the subpoenas previously issued for the bank property records of several pork barrel scam whistleblowers including Benhur Luy.<\/p>\n<p>The state prosecutors reminded the anti-graft court that the whistleblowers are not the accused in the case, in a motion for reconsideration.<\/p>\n<p>They also added that Luy\u2019s and the other whistleblowers\u2019 bank accounts \u201ccannot be considered as subject matter for litigation.\u201d<\/p>\n<p>It could be noted that the Fifth Division of the Sandiganbayan has granted the motion filed last Sept. 4 by the accused in the pork scam including the alleged pork scam mastermind, Janet Lim Napoles.<\/p>\n<p>In the said motion, Napoles\u2019 lawyers asked the court to subpoena the bank records as well as the travel records of Luy and other pork scam whistleblowers.<\/p>\n<p>The granting of the motion has led to the state prosecutors\u2019 filing of another motion seeking to quash and recall the subpoena released by the court.<\/p>\n<p>The prosecutors likened the subpoena to a \u201cfishing expedition\u201d because \u201cthe request made is broad in nature in which would require the banks concerned to provide voluminous documents and records containing information that may have neither value nor relevance to the instant case.\u201d<\/p>\n<p>They also added that \u201cthe disclosure of the bank records and the transactions of the persons indicated in the subpoena violates Section 2 and 3 of Republic Act 1405, otherwise known as \u2018An Act Prohibiting Disclosure of or Inquiry into, Deposits With Any Banking Institution\u2019.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>MANILA \u2013 The Sandiganbayan was asked to withdraw the subpoenas previously issued for the bank property records of several pork &hellip;<\/p>\n","protected":false},"author":44,"featured_media":14228,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[95],"tags":[7791,5978,1594],"class_list":["post-25587","post","type-post","status-publish","format-standard","has-post-thumbnail","category-news-ph","tag-bank-records","tag-prosecutors","tag-sandiganbayan","mauthors-lei-fontamillas","mauthors-philippine-canadian-inquirer"],"_links":{"self":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts\/25587","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/users\/44"}],"replies":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/comments?post=25587"}],"version-history":[{"count":0,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts\/25587\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/media\/14228"}],"wp:attachment":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/media?parent=25587"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/categories?post=25587"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/tags?post=25587"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
