MANILA<\/strong>\u00a0— The \u201cverbal\u201d fishing deal made between President Rodrigo Duterte and Chinese President Xi Jinping to allow Chinese nationals to fish within the Philippine exclusive economic zone (EEZ) is still \u201clegally binding\u201d, Malaca\u00f1ang said on Monday.<\/p>\n

Presidential Spokesperson Salvador Panelo made this remark a week after Duterte bared that he had an agreement with Xi to allow Chinese to fish within the Philippines\u2019 200-nautical mile EEZ if China allowed Filipinos to fish in the Panatag (Scarborough) Shoal during their first bilateral meeting in October 2016.<\/p>\n

In an interview at cable ANC television, Panelo described the agreement as an \u201cinformal agreement other than documented\u201d.<\/p>\n

Panelo, in a Palace briefing on Monday, said the agreement was likely \u201cverbal\u201d but it was still legally binding.<\/p>\n

\u201cKahit sa batas, kahit na verbal eh valid and binding iyon basta mayroong mutual consent ang dalawang partido. Kaya nga agreement eh<\/em>(Even in the law, even if it\u2019s verbal, it\u2019s valid and binding as long as there is mutual consent from the two parties. That\u2019s why it\u2019s an agreement),\u201d said Panelo, also the Presidential Chief Legal Counsel.<\/p>\n

Asked if he believed Xi would hold on to his end of the deal, Panelo noted that there have yet to be reports of Chinese nationals fishing in the Recto Bank (Reed Bank) in the West Philippine Sea.<\/p>\n

\u201cEh sa ngayon hindi naman niya ginagalaw ang<\/em>\u00a0Reed Bank,\u00a0\u2018di ba?<\/em>\u00a0Gaya ng pangako niya (Now, they\u2019re not fishing in the Reed Bank, right? Just as he promised),\u201d Panelo said.<\/p>\n

Following calls by members of party-list group Bayan Muna for Malaca\u00f1ang to present the \u201ccomplete text\u201d of the supposed fishing deal between Duterte and Xi, Panelo said the Palace has long bared the existence of the agreement on several occasions.<\/p>\n

\u201cKahit ako, sinasabi ko na iyan. Nagkakaroon ng usapan kaya nga okay na doon sa<\/em>\u00a0Scarborough\u00a0eh<\/em>\u00a0(I have even mentioned that. There was an agreement that\u2019s why our fishermen are now allowed at the Scarborough),\u201d Panelo said.<\/p>\n

Oil exploration<\/strong><\/p>\n

Panelo, meanwhile, bared that the Philippines is willing to hold bilateral meetings with China on the proposed joint oil exploration in the South China Sea.<\/p>\n

Duterte earlier suggested a 60-40 sharing arrangement on the joint oil exploration.<\/p>\n

Although the chief executive bared that China may disagree on a 60-40 sharing deal of resources, Panelo believed that the two countries could still talk it out.<\/p>\n

\u201cLahat naman \u2018yan puwedeng pag-usapan<\/em>\u00a0(because all of that can be discussed),\u201d Panelo said.<\/p>\n

Panelo pointed out that the reason why joint ventures were necessary is because the Philippines lacks capacity to do it alone.<\/p>\n

\u201cUnang-una, wala tayong resources<\/em>\u00a0(First of all, we don\u2019t have resources) the reason why we need joint ventures and joint agreements with other countries is because\u00a0wala tayong kapasidad<\/em>\u00a0(we don\u2019t have the capacity),\u201d he added.<\/p>\n

Duterte earlier bared that Xi warned of \u201ctrouble\u201d after the Filipino leader mentioned his plan to dig for oil in the disputed waters.<\/p>\n","protected":false},"excerpt":{"rendered":"
