{"id":186670,"date":"2018-10-23T06:19:28","date_gmt":"2018-10-23T10:19:28","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=186670"},"modified":"2018-10-23T06:41:26","modified_gmt":"2018-10-23T10:41:26","slug":"calida-appeal-trillanes-ruling-ca","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2018\/10\/23\/calida-appeal-trillanes-ruling-ca\/","title":{"rendered":"Calida to appeal Trillanes ruling before CA"},"content":{"rendered":"<figure id=\"attachment_112227\" aria-describedby=\"caption-attachment-112227\" style=\"width: 415px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/08\/SolGen-Calida_1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-112227 size-full\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/08\/SolGen-Calida_1.jpg\" alt=\"\" width=\"415\" height=\"260\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/08\/SolGen-Calida_1.jpg 415w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/08\/SolGen-Calida_1-300x188.jpg 300w\" sizes=\"auto, (max-width: 415px) 100vw, 415px\" \/><\/a><figcaption id=\"caption-attachment-112227\" class=\"wp-caption-text\">\u201cI\u2019ve talked to SolGen and he said, he will not file a motion for reconsideration but (will) go immediately to the Court of Appeals and appeal the ruling of the court with respect to the non-issuance of the warrant arrest.\u201d (PNA file photo)<\/figcaption><\/figure>\n<p><strong>MANILA<\/strong>\u00a0&#8212; Malaca\u00f1ang on Tuesday said Solicitor General Jose Calida will elevate a Makati court\u2019s decision denying the Department of Justice\u2019s petition for an alias arrest warrant and travel ban against Senator Antonio Trillanes IV to the Court of Appeals (CA).<\/p>\n<p>Presidential Spokesperson and Chief Presidential Legal Counsel Salvador Panelo said Calida will file \u2018very soon\u2019 a petition seeking the reversal of the decision before the CA.<\/p>\n<p>\u201cI\u2019ve talked to SolGen and he said, he will not file a motion for reconsideration but (will) go immediately to the Court of Appeals and appeal the ruling of the court with respect to the non-issuance of the warrant arrest,\u201d Panelo said in a Palace press briefing.<\/p>\n<p>Panelo said the appeal will also be based on Makati Regional Trial Court (RTC) Branch 148 Judge Andres Soriano\u2019s claim that the ruling was based on \u201csecondary evidence and not primary evidence\u201d.<\/p>\n<p>\u201cThere are procedural matters decided by the court which to my mind are erroneous how he looks at evidence despite the fact that they are only secondary evidence. So there are questions that can be properly raised in the Court of Appeals and subsequently in the Supreme Court,\u201d Panelo said.<\/p>\n<p>He said the RTC Branch 148\u2019s rejection of arrest warrant was just \u201cpyrrhic victory\u201d for Trillanes since the court ruled that President Rodrigo Duterte\u2019s Proclamation 572 was valid.<\/p>\n<p>The proclamation declared the amnesty granted to Trillanes as void ab initio (from the beginning) due to the former Navy officer\u2019s failure to submit amnesty documents including admission of guilt for his rule in the 2003 Oakwood Mutiny and 2007 Manila Peninsula incident.<\/p>\n<p>\u201cIt\u2019s more a pyrrhic victory because if you noticed the court decided that the proclamation issued by the President is valid. They are claiming at the time the President does not have to power to void any amnesty. The court says he has,\u201d Panelo said.<\/p>\n<p>\u201cSo until this is decided by the Supreme Court said we\u2019re wrong, we will consistently make our stand that we are right,\u201d he added.<\/p>\n<p>Panelo, meanwhile, questioned the court\u2019s decision to hear the case when it claimed it cannot issue the warrant of arrest due to \u201cprinciple of immutability of judgment\u201d.<\/p>\n<p>\u201cNow, the court is saying that it cannot issue the warrant of arrest because of the principle of immutability of judgment. But I\u2019m wondering why, because effectively that would mean it has no jurisdiction over the case.
