{"id":181558,"date":"2018-09-14T22:11:24","date_gmt":"2018-09-15T02:11:24","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=181558"},"modified":"2018-09-14T22:11:24","modified_gmt":"2018-09-15T02:11:24","slug":"chretien-romanow-mcmurtry-condemn-fords-use-notwithstanding-clause","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2018\/09\/14\/chretien-romanow-mcmurtry-condemn-fords-use-notwithstanding-clause\/","title":{"rendered":"Chretien, Romanow, McMurtry condemn Ford&#8217;s use of notwithstanding clause"},"content":{"rendered":"<figure id=\"attachment_168339\" aria-describedby=\"caption-attachment-168339\" style=\"width: 640px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2018\/06\/640px-Doug_Ford_2014_parade.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-168339\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2018\/06\/640px-Doug_Ford_2014_parade.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2018\/06\/640px-Doug_Ford_2014_parade.jpg 640w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2018\/06\/640px-Doug_Ford_2014_parade-300x200.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><figcaption id=\"caption-attachment-168339\" class=\"wp-caption-text\">&#8220;Section 33 makes it clear that the elected legislature, not the judiciary, should have the final say over certain laws.&#8221; (<a href=\"https:\/\/commons.wikimedia.org\/w\/index.php?curid=66924228\">File Photo By Bruce Reeve, CC BY-SA 2.0<\/a>)<\/figcaption><\/figure>\n<p class=\"p1\">TORONTO \u2014 Three prominent former politicians who negotiated the inclusion of the notwithstanding clause in the Charter of Rights and Freedoms are condemning the Ontario government&#8217;s use of the rare provision to push through legislation that was deemed unconstitutional by the courts.<\/p>\n<p class=\"p1\">Former prime minister Jean Chretien, former Saskatchewan premier Roy Romanow and former Ontario attorney general Roy McMurtry issued a statement Friday saying the clause wasn&#8217;t meant to be used in this way.<\/p>\n<p class=\"p1\">&#8220;The clause was designed to be invoked by legislatures in exceptional situations, and only as a last resort after careful consideration,&#8221; they said. &#8220;It was not designed to be used by governments as a convenience or as a means to circumvent proper process.&#8221;<\/p>\n<p class=\"p1\">The three men urged Ontario&#8217;s Progressive Conservative legislators to break ranks with Premier Doug Ford, who announced Monday he would invoke the notwithstanding clause to override a judge&#8217;s ruling on legislation concerning the size of Toronto&#8217;s city council.<\/p>\n<p class=\"p1\">&#8220;We condemn his actions and call on those in his cabinet and caucus to stand up to him,&#8221; they said. &#8220;History will judge them by their silence.&#8221;<\/p>\n<p class=\"p1\">When asked about the comments, a spokeswoman for Ford said the Ontario government was using the part of Constitution &#8220;designed specifically to ensure that the will of an elected legislature is respected.&#8221;<\/p>\n<p class=\"p1\">&#8220;Section 33 makes it clear that the elected legislature, not the judiciary, should have the final say over certain laws,&#8221; Laryssa Waler said in a statement.<\/p>\n<p class=\"p1\">A Toronto judge this week struck down legislation to slash the size of Toronto city council in the middle of an election, saying it infringed on voters&#8217; and candidates&#8217; right to free expression.<\/p>\n<p class=\"p1\">Ford justified using the notwithstanding clause when he reintroduced the legislation, saying that &#8220;politically appointed&#8221; judges shouldn&#8217;t interfere with democratically elected governments.<\/p>\n<p class=\"p1\">The premier also touted Chretien as a supporter of the clause when pressed on the issue during question period Thursday.<\/p>\n<p class=\"p1\">Former Tory premier Bill Davis has also spoken out against Ford&#8217;s decision, as have\u00a0Canada&#8217;s big city mayors and all 25 Liberal MPs from Toronto.<\/p>\n<p class=\"p1\">Toronto city council, meanwhile, has asked the federal government to intervene.
