MANILA \u2013 Senator Juan Edgardo Angara said on Thursday that the College of St. Benilde must be held accountable for subsidiary liabilities for the death of the hazing victim, Guillio Cesar Servando.<\/p>\n

Servando, a sophomore student of St. Benilde, was reported to have died because of severe physical injuries he allegedly acquired from a hazing initiation conducted by members of the Tau Gamma Phi fraternity.<\/p>\n

\u201cUnder the Family Code, schools, for example,\u00a0kapag naaksidente \u2018yung anak mo<\/em>,\u00a0may\u00a0<\/em>(when your child meets an accident, have) subsidiary liabilities. In the same way, that principle should also be applied (to victims of hazing by) fraternities,\u201d Angara said in a Philippine Star Report .<\/p>\n

Angara, who is a lawyer belonging to the University of the Philippine\u2019s SigmaRho fraternity said that this same principle is adopted by the Anti-Hazing Law.<\/p>\n

\u201cIn fact, it is (the school\u2019s role) to be aware of what\u2019s going on, and to have a — (for) each fraternity to be recognized, you must have a faculty adviser under the law,\u201d he said.<\/p>\n

He also cited that in UP, a faculty adviser is required for each fraternity so that he or she will be \u201cadministratively liable\u201d for any transgressions committed by the group.<\/p>\n

\u201cThat\u2019s what happens in UP. There are faculty advisers.\u00a0Kapag may nangyari na gulo, may nag<\/em>-rumble for example\u00a0\u2018yung mga\u00a0<\/em>fraternities,\u00a0pinapatawag \u2018yung mga\u00a0<\/em>advisers. \u2018Mag-usap kayo, ano ba\u2019ng nangyari dyan<\/em>\u2019 (When trouble erupts, for example if fraternities engage in rumbles, the advisers arer summoned. \u2018You talk, what happened here\u2019)?\u201d Angara said.<\/p>\n

Reviewing the Anti-Hazing Law, Angara said the owner of the house where the initiation happened is also liable for the student\u2019s death.<\/p>\n

\u201cAnd let\u2019s run after everybody who was involved. Under the anti-hazing law,\u00a0kahit wala ka doon nu\u2019ng<\/em>hazing,\u00a0kapag ikaw ang may-ari nu\u2019ng bahay at alam mong may\u00a0<\/em>hazing\u00a0doon<\/em>, liable\u00a0ka din<\/em>.Mananagot ka rin dapat<\/em>.\u00a0Kapg ikaw ay\u00a0<\/em>officer\u00a0ng\u00a0<\/em>fraternity,\u00a0kahit wala ka doon, kahit hindi ka nag<\/em>-paddle (even if you were not there during the hazing, if you own the house and you knew there was hazing there, you are liable. You should be held accountable too. If you are an officer of the fraternity, even if you weren\u2019t there, even if you did not wield the paddle),\u201d he said.<\/p>\n

Despite what happened, Angara, like other senators who are also members of fraternities, said it is not necessary to ban fraternities.<\/p>\n

\u201cI don\u2019t think you can do that that would be unconstitutional because the freedom of association is guaranteed under (the Constitution). A fraternity is just an association; it\u2019s an aggrupation of persons.Hindi mo puwedeng ipagbawal \u2018yan<\/em>\u00a0(You cannot ban that),\u201d Angara said.<\/p>\n
