Duterte\u2019s statement that the practice of Chinese Coast Guard personnel taking catch from Filipino fishermen in the Panatag (Scarborough) Shoal is barter, albeit an imperfect one.<\/p>\n<p>\u201c<em>Ang sabi nga (ng) Presidente, barter, pero walang pagkakasundo sa valuation. So hindi po siya talagang perfected contract of barter<\/em>\u00a0(The President said it was barter but there was no agreement on valuation. So, it\u2019s really not a perfected contract of barter),\u201d Roque said in a briefing in Cotabato City.<\/p>\n<p>He reiterated that it was Duterte himself who said that because there is no agreement on the valuation of Filipino fishermen\u2019s catch, it means that there is no contract.<\/p>\n<p>He also pointed out that a proper barter should involve a contract where both parties agree on an exchange of goods and services without the use of money.<\/p>\n<p>\u201c<em>Presidente na rin ang nagsabi walang agreement sa valuation, so wala talagang kontrata ng barter kasi bago ka magkaroon ng barter, kinakailangan magkasundo sa lahat, including \u2018yung presyo<\/em>\u00a0(The President himself said that there\u2019s no agreement on the valuation, so there\u2019s no contract on barter because before there\u2019s a barter, there\u2019s a need to agree on all terms, including the price of the goods),\u201d Roque explained.<\/p>\n<p>He, meanwhile, denied that Duterte was preempting the investigation being conducted by the Chinese government in relation to its Coast Guard personnel forcibly taking fish from Filipino fishermen in the Panatag Shoal.<\/p>\n<p>\u201c<em>Hindi naman po siguro<\/em>\u00a0(I don\u2019t think so),\u201d Roque said when asked by reporters.<\/p>\n<p><strong>Lost in translation<\/strong><\/p>\n<p>Duterte earlier blamed the language barrier between Filipino fishermen and Chinese Coast Guard personnel for the barter\u2019s valuation problem.<\/p>\n<p>\u201cIt was a barter in exchange for the &#8212; \u2018<em>yung isda<\/em>\u00a0(fish),\u201d Duterte said in a speech at the Department of Foreign Affairs (DFA) during the agency\u2019s 120th anniversary celebration on Monday night.<\/p>\n<p>\u201c<em>Eh ang problema, ang valuation. Hindi tayo nagkakaintindihan dito<\/em>\u00a0(The problem is valuation. We don\u2019t understand each other),\u201d he added.<\/p>\n<p>Duterte also refused to call the act of the Chinese Coast Guard taking catch as a \u201cseizure.\u201d<\/p>\n<p>Chinese Ambassador to the Philippines Zhao Jianhua has assured that if the Panatag incident is proven, the Chinese government will discipline erring coast guards in accordance with their own regulations.<\/p>\n<p>He said that as a rule, their government will not allow the Chinese Coast Guard \u201cto do anything that is harmful to the Filipino fishermen.\u201d<\/p>\n<p>He added, \u201cfriendly arrangements\u201d between the Philippines and China currently allow Filipino fishermen to fish and \u201cthat will not be changed.\u201d<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>MANILA\u00a0&#8212; Presidential Spokesperson Harry Roque on Tuesday echoed President Rodrigo R.
