(<a href=\"https:\/\/www.facebook.com\/laborandemployment\/photos\/pcb.1427982967330222\/1427977887330730\/?type=3&amp;theater\">Photo<\/a>: <a href=\"https:\/\/www.facebook.com\/laborandemployment\/\">Department of Labor and Employment &#8211; DOLE\/Facebook<\/a>)<\/figcaption><\/figure>\n<p>Lawmakers from progressive Makabayan bloc downplayed the signing of an executive order (EO) prohibiting illegal contracting and subcontracting, and ensuring workers\u2019 right to security of tenure.<\/p>\n<p>Bayan Muna Representative Carlos Zarate, Anakpawis Representative Ariel Casilao, and Kabataan Representative Sarah Elago said the EO is \u201cuseless\u201d and offers \u201cnothing new\u201d in the fight against endo or end of contract.<\/p>\n<p><em>\u201cWalang silbi ang<\/em> EO <em>na nilagdaan dahil ang pagbababawal sa<\/em> labor only contracting (LOC) <em>ay nasa<\/em> Labor Code <em>na <\/em>(The EO is useless because prohibiting labor only contracting is already in the Labor Code)<em>,\u201d<\/em> Zarate said on Tuesday.<\/p>\n<p><em>\u201cGusto lang ng<\/em> EO <em>na ito ay pahupain ang galit ng mga manggagawa sa pagtalikod ni Pang.<\/em> Duterte [President Rodrigo Duterte] <em>sa pangako niyang wakasan ang endo at kontraktwalisasyon <\/em>(The EO was just trying to appease the rage of workers due to President Duterte\u2019s unfulfilled promise to end endo and contractualization)<em>,\u201d<\/em>\u00a0he added.<\/p>\n<p>The lawmaker urged the government to formalize a policy which prohibits all forms of job contracting.<\/p>\n<p>Casilao, meanwhile, also pointed out that there is nothing new with the EO as it only \u201creiterates\u201d existing labor laws in the country that have been proven to be \u201canti-worker.\u201d<\/p>\n<p>What workers demanded, according to Casilao, is a \u201ctotal prohibition of contractualization by virtue of direct hiring.\u201d<\/p>\n<p>\u201cPermissible and allowable contractualization should only be limited to seasonal and project-based work with a strict provision of prohibiting repeated hiring of project based with same principal employer,\u201d he said.<\/p>\n<p><em>\u201cDapat nailagay sana sa<\/em> EO <em>na pangunahing prinsipyo ng gobyerno ang<\/em> (They should have included in the EO that the government\u2019s primary policy is making) direct hiring as a basic principle of employment,\u201d he continued.<\/p>\n<p>Elago, for her part, said that the President \u201cdesperately\u201d attempted to \u201cput up a show\u201d by signing the EO to strengthen security of tenure.<\/p>\n<p>&#8220;The EO does not live up to its promise of &#8216;strengthening&#8217; security of tenure even if it imposes penalties and prohibits subcontracting or illegal contracting. These are obviously not enough as we have seen how big businesses have been able to circumvent the law even with these prohibitions,&#8221; Elago stressed.<\/p>\n<p>She noted that the \u201creal evil\u201d lies in contractualization itself and not merely in subcontracting.<\/p>\n<p>&#8220;What employers avoid is the regularization of employees in order to evade providing higher wages and benefits. Big contractors [will] gain profit from this scheme,&#8221; the lawmaker said.<\/p>\n<p>Elago added that accepting a \u201cweak and compromising\u201d EO and not pushing for the end of contractualization in all forms \u201cwould be a huge disservice to the long-fought struggle for workers&#8217; rights and welfare.\u201d<\/p>\n<p>The EO was signed by Duterte at the start of his speech during a Labor Day event in Cebu today, May 1.
