Malaca\u00f1ang on Monday, April 30, asserts the legality of the President\u2019s proposal of a 60-40 share with China in the two countries\u2019 joint exploration of the West Philippine Sea.<\/p>\n

Citing a Supreme Court decision back in 2004, Presidential Spokesperson Harry Roque, Jr. defended that President Rodrigo Roa Duterte is allowed to offer such deal of sharing with China.<\/p>\n

\u201cUnder La Bugal, the President is allowed. \u2018Yun nga ang pagkakamali ng mga<\/em> (That is the mistake of) self-professed and [self-]proclaimed experts, basahin ninyo<\/em> (you should read the) La Bugal versus Department of Environment and Natural Resources (DENR) [decision],\u201d Roque said.<\/p>\n

The spokesman even challenged those \u2018experts\u2019 to read the case.<\/p>\n

\u201c\u2018Yung mga nagsasabi na<\/em> illegal \u2018yan, basahin ang kaso ng <\/em>La Bugal at kung ayaw ninyong basahin, wala na akong magagawa. Wala pong gamot sa ayaw magbasa ng batas <\/em>(For those saying that it is illegal, read the La Bugal case, and if you do not want to read, I can no longer do anything. There is no cure for those who do not want to read the law),\u201d he added.<\/p>\n

Roque further explained that the only legal requirement is the Congress\u2019 copy.<\/p>\n

\u201cAng<\/em> requirement ng Saligang Batas lang bigyan ninyo kami ng kopya ang\u2026 ang Kongreso \u2018pag meron na kayong kasunduan na nakasulat <\/em>(The only requirement of the Constitution is to provide a copy to the Congress once there is a written agreement),\u201d he said.<\/p>\n

When asked by the media if Duterte\u2019s offer was discussed in the bilateral meeting with Chinese President Xi Jinping, Roque, who was present during the meeting, said that was not the case.<\/p>\n

Duterte made his proposal public last week during one of his speeches in Davao.<\/p>\n

\u201cPrecisely, I said when the issue of the China Sea, leave it at that. It\u2019s geopolitics. Anyway, China has offered joint exploration and joint operation.<\/p>\n
