(PNA Photo)<\/figcaption><\/figure>\n<p>The Supreme Court (SC) ordered Solicitor General Jose Calida to respond to the comment of Chief Justice Maria Lourdes Sereno on a petition to oust her from her post as the country\u2019s top magistrate.<\/p>\n<p>In a full court session presided by acting Chief Justice Antonio Carpio on Tuesday, March 20, the High Court gave Calida, who filed the 34-page petition for quo warranto against Sereno, five days to submit his reply upon receipt of notice.<\/p>\n<p>\u201cIn the matter of G.R. No. 237428 (Republic of the Philippines, represented by Solicitor General Jose C. Calida v. Maria Lourdes P. A. Sereno), the Court directed the Solicitor General to submit the Republic\u2019s Reply to the respondent Chief Justice\u2019s Comment within five (5) days from its receipt of notice,\u201d the SC\u2019s resolution read.<\/p>\n<p>Earlier this month, the Solicitor General sought Sereno\u2019s removal from the judiciary\u2019s top post through a quo warranto petition before the High Court, citing her alleged failure to submit her statements of assets, liabilities, and net worth (SALNs) to the Judicial and Bar Council (JBC)\u00a0when she applied for the top magistrate post in 2012.<\/p>\n<p>Calida said that Sereno\u2019s blatant disregard to comply with the requirements of the law and Constitution \u201cproves her lack of integrity, hence she is unlawfully holding the position as the Chief Justice of the Supreme Court.\u201d<\/p>\n<p>In response to this petition, Sereno\u2019s camp on Monday sought the dismissal of Calida\u2019s appeal for lack of jurisdiction and merit.<\/p>\n<p>Sereno, in her 77-page comment, said that the SC has no power to remove her, citing Section 2, Article XI of the 1987 Constitution and jurisprudence as basis.
