(<a href=\"https:\/\/www.facebook.com\/decapitated\/photos\/a.10150747108735991.451906.11960700990\/10155459892415991\/?type=1&amp;theater\">Photo<\/a>: <a href=\"https:\/\/www.facebook.com\/decapitated\/\">Decapitated\/Facebook<\/a>)<\/figcaption><\/figure>\n<p>SPOKANE, Wash. \u2014 Rape and kidnapping charges against all four members of a Polish death metal band were dropped Friday by prosecutors in Washington state.<\/p>\n<p>The band members have been detained in the United States since a woman claimed that she was gang-raped after a concert last year in Spokane, Washington.<\/p>\n<p>Prosecutors filed a motion in Spokane County Superior Court dismissing the charges against members of Decapitated, citing only the \u201cwell-being of the victim,\u201d as the reason.<\/p>\n<p>A trial for the four men had been scheduled for Jan. 16.<\/p>\n<p>\u201cWe feel it was the result of everyone taking a second look at this matter in light of new evidence,\u201d said Steve Graham, attorney for band member Waclaw Kieltyka, 35.<\/p>\n<p>\u201cThey are headed back home this week,\u201d Graham said of the band members.<\/p>\n<p>Kelly Fitzgerald, a Spokane County deputy prosecutor handling the case, was not immediately available for comment.<\/p>\n<p>The charges were dismissed without prejudice, meaning the four men could be charged again in the future.<\/p>\n<p>According to court documents, a woman told police that she was invited onto the tour bus after the band&#8217;s show on Aug. 31. The woman claimed that she was raped in the bathroom of the bus.<\/p>\n<p>Band members were arrested in Los Angeles County, California, after a show there Sept. 9 and extradited to Spokane.<\/p>\n<p>The other three band members are Michal Lysejko, 27; Rafal Piotrowski, 31; and Hubert Wiecek, 30.<\/p>\n<p>The state&#8217;s case largely consisted of testimony from two women who told police that they were held against their will on the band&#8217;s tour bus after the show. One of the women was able to get off the bus.<\/p>\n<p>The woman who remained on the bus told police that she was raped by each member of the band.
