{"id":141854,"date":"2017-12-26T02:56:58","date_gmt":"2017-12-26T07:56:58","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=141854"},"modified":"2017-12-26T02:56:58","modified_gmt":"2017-12-26T07:56:58","slug":"doj-set-to-file-formal-petition-tagging-cpp-npa-as-terrorist-group","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2017\/12\/26\/doj-set-to-file-formal-petition-tagging-cpp-npa-as-terrorist-group\/","title":{"rendered":"DOJ set to file formal petition tagging CPP-NPA as terrorist group"},"content":{"rendered":"<figure id=\"attachment_133919\" aria-describedby=\"caption-attachment-133919\" style=\"width: 640px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/11\/111616-AAA-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-133919\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/11\/111616-AAA-2.jpg\" alt=\"FILE: Justice Secretary Vitaliano Aguirre II issued Department Order no. 779 directing the Office of Prosecutor General to file the necessary application or petition with the appropriate court for the proscription or declaration of the Communist Party of the Philippines-New People's Army as a terrorist organization pursuant to Republic Act (RA) 9372 also known as \u201cHuman Security Act of 2007.\u201d (ALBERT ALCAIN\/Presidential Photo) \" width=\"640\" height=\"427\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/11\/111616-AAA-2.jpg 640w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/11\/111616-AAA-2-300x200.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><figcaption id=\"caption-attachment-133919\" class=\"wp-caption-text\">FILE: Justice Secretary Vitaliano Aguirre II issued Department Order no. 779 directing the Office of Prosecutor General to file the necessary application or petition with the appropriate court for the proscription or declaration of the Communist Party of the Philippines-New People&#8217;s Army as a terrorist organization pursuant to Republic Act (RA) 9372 also known as \u201cHuman Security Act of 2007.\u201d (ALBERT ALCAIN\/Presidential Photo)<\/figcaption><\/figure>\n<p>MANILA\u00a0&#8212; The Department of Justice (DOJ) is carefully studying the formal petition they plan to file this week before the regional trial court officially declaring as terrorist groups the Communist Party of the Philippines (CPP) and its armed wing, the New People\u2019s Army (NPA).<\/p>\n<p>Justice Secretary Vitaliano Aguirre II issued Department Order no. 779 directing the Office of Prosecutor General to file the necessary application or petition with the appropriate court for the proscription or declaration of the Communist Party of the Philippines-New People&#8217;s Army as a terrorist organization pursuant to Republic Act (RA) 9372 also known as \u201cHuman Security Act of 2007.\u201d<\/p>\n<p>It has been almost a month since President Rodrigo Duterte declared the CPP-NPA as terrorists but Aguirre explained that they have to prepare the petition very carefully.<\/p>\n<p>He noted that as part of the preparations, prosecutors have to seek the help of the intelligence community.<\/p>\n<p>\u201cOur DOJ prosecutors led by the head of task force, Prosecutor Peter Ong, has been meeting with the intelligence people katulad ng (like) NICA (National Intelligence Coordinating Agency), ISAFP (Intelligence Service of the Armed Forces of the Philippines) and other intelligence agencies of the government,\u201d he said.<\/p>\n<p>Aguirre is optimistic that the lower court would grant the government\u2019s request following President Rodrigo Duterte\u2019s proclamation naming the CPP and NPA as terror organizations.<\/p>\n<p>Presidential Spokesperson Harry Roque earlier announced that the President has signed a proclamation formally designating the CPP-NPA as a terrorist organization.<\/p>\n<p>The Palace spokesperson said the President signed the proclamation pursuant to the provisions of Republic Act No. 10168 or the Human Security Act.<\/p>\n<p>Roque said under the law, affiliate revolutionary groups of the CPP-NPA would also be considered terrorist groups, and anyone proven to be financing them would be held liable.<\/p>\n<p>Citing the pertinent provisions of RA 10168, Roque said a designated person is \u201cany person or entity designated or identified as a terrorist, as one who finances terrorism or a terrorist organization or group under the applicable United Nations Security Council resolution or by another jurisdiction or supranational jurisdiction and pursuant to the proclamation which implements the Human Security Act.\u201d<\/p>\n<p>\u201cTake note that the domestic statute and the UN Security Council prohibit the giving of funds to terrorist organizations.
