{"id":141029,"date":"2017-12-21T23:32:26","date_gmt":"2017-12-22T04:32:26","guid":{"rendered":"https:\/\/canadianinquirer.net\/v1\/?p=141029"},"modified":"2017-12-21T23:32:26","modified_gmt":"2017-12-22T04:32:26","slug":"nestle-warned-it-lacks-rights-to-some-california-water","status":"publish","type":"post","link":"https:\/\/canadianinquirer.net\/v1\/2017\/12\/21\/nestle-warned-it-lacks-rights-to-some-california-water\/","title":{"rendered":"Nestle warned it lacks rights to some California water"},"content":{"rendered":"<figure id=\"attachment_95303\" aria-describedby=\"caption-attachment-95303\" style=\"width: 488px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/03\/1506770_880951941963308_1415256751910809331_n.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-95303\" src=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/03\/1506770_880951941963308_1415256751910809331_n.jpg\" alt=\"FILE: (Photo: Nestl\u00e9\/Facebook)\" width=\"488\" height=\"489\" srcset=\"https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/03\/1506770_880951941963308_1415256751910809331_n.jpg 488w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/03\/1506770_880951941963308_1415256751910809331_n-150x150.jpg 150w, https:\/\/canadianinquirer.net\/v1\/wp-content\/uploads\/2017\/03\/1506770_880951941963308_1415256751910809331_n-300x300.jpg 300w\" sizes=\"auto, (max-width: 488px) 100vw, 488px\" \/><\/a><figcaption id=\"caption-attachment-95303\" class=\"wp-caption-text\">FILE: (Photo: Nestl\u00e9\/Facebook)<\/figcaption><\/figure>\n<p>LOS ANGELES \u2014 Nestle, which sells Arrowhead bottled water, may have to stop taking millions of gallons of water from Southern California&#8217;s San Bernardino National Forest because state regulators concluded it lacks valid permits.<\/p>\n<p>The State Water Resources Control Board notified the company on Wednesday that an investigation concluded it doesn&#8217;t have proper rights to about three-quarters of the water it withdraws for bottling.<\/p>\n<p>\u2018\u2018A significant portion of the water currently diverted by Nestle appears to be diverted without a valid basis of right,\u2019\u2018 the report concluded.<\/p>\n<p>Nestle Waters North America was urged to cut back its water withdrawals unless it can show it has valid water rights to its current sources or to additional groundwater.<\/p>\n<p>The company, a division of the Swiss food giant, also was given 60 days to submit an interim compliance plan.<\/p>\n<p>Nestle said it was pleased that the report reaffirms that it holds valid rights to \u2018\u2018a significant amount\u2019\u2018 of water.<\/p>\n<p>\u2018\u2018We will continue to operate lawfully according to these existing rights and will comply fully with California law,\u2019\u2018 Nestle added in a statement.<\/p>\n<p>The report also was applauded by activists who have fought to turn off Nestle&#8217;s tap in the forest.<\/p>\n<p>Amanda Frye, who filed one of the complaints that prompted the investigation, said she was pleased with the result although she hadn&#8217;t read the entire report.<\/p>\n<p>\u2018\u2018I feel like it&#8217;s a victory,\u2019\u2018 Frye told the Desert Sun of Palm Springs. \u2018\u2018I&#8217;m happy that the State Water Resources Control Board did pursue it and look into it. I feel that they&#8217;re protecting the people of California.\u2019\u2018<\/p>\n<p>Nestle took about 32 million gallons of water from wells and water collection tunnels in the forest last year. A long water board investigation concluded that it only had the right to withdraw 26 acre-feet per year, or about 8.5 million gallons.<\/p>\n<p>Nestle has contended that it inherited rights dating back more than a century to collect water from the forest northeast of Los Angeles.
