Photo by Mike Gonzales courtesy of Wiki Commons.<\/figcaption><\/figure>\n<p>MANILA &#8212; The Supreme Court (SC) on Tuesday did not issue a temporary restraining order (TRO) against the implementation of the Enhanced Defense Cooperation Agreement (EDCA) between the Philippines and the United States.<\/p>\n<p>Instead, the High Court ordered the respondents in the case to submit their respective comment on the petition questioning the constitutionality of the EDCA within 10 days from notice.<\/p>\n<p>The respondents are Executive Secretary Paquito Ochoa Jr. and Defense Secretary Voltaire Gazmin.<\/p>\n<p>Meanwhile, the SC ordered the consolidation of the petitions against the EDCA filed by former Senators Rene Saguisag and Wigberto Tanada and the group of Bagong Alyansang Makabayan.<\/p>\n<p>The petitioners argued that the EDCA violates Article 2, Section 8 of the 1987 Constitution, which prohibits the entry of nuclear weapons into the country because the EDCA does not state that it prohibits the entry of nuclear weapons into the Philippines.<\/p>\n<p>They cited that only the prepositioning of nuclear weapons is prohibited under the EDCA.<\/p>\n<p>The petitioners further argued that the EDCA should be nullified because it compromises the national interest.<\/p>\n<p>They also believe that the EDCA is a treaty which requires the ratification by the Senate.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>MANILA &#8212; The Supreme Court (SC) on Tuesday did not issue a temporary restraining order (TRO) against the implementation of &hellip;<\/p>\n","protected":false},"author":44,"featured_media":4486,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[95],"tags":[2825,1144,3838],"class_list":["post-13455","post","type-post","status-publish","format-standard","has-post-thumbnail","category-news-ph","tag-edca","tag-supreme-court","tag-tro","mauthors-perfecto-t-raymundo-jr","mauthors-philippines-news-agency"],"_links":{"self":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts\/13455","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/users\/44"}],"replies":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/comments?post=13455"}],"version-history":[{"count":0,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts\/13455\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/media\/4486"}],"wp:attachment":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/media?parent=13455"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/categories?post=13455"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/tags?post=13455"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
