Apparently, that\u2019s not in accordance with the guidelines,\u201d Assistant CSC Commissioner for Legal Affairs Ariel Ronquillo told reporters in an interview at the Senate.<\/p>\n<p>\u201c<em>Sa guidelines na in-issue namin, ang pwede lang i-shade ay yung address ng filer<\/em>\u00a0(In the guidelines we issued, the only portion that can be shaded is the address of the filer). The rest should be open to the public,\u201d he added.<\/p>\n<p>Ronquillo made this statement after Malacanang defended its decision to redact portions of Cabinet members&#8217; SALN saying it was in line with the Data Privacy Act.<\/p>\n<p>\u201c<em>Yun yata ang naging interpretation nila dun<\/em>\u00a0(That might have been the Executive\u2019s interpretation) because of the Data Privacy Act. Although we have taken the position that the SALN should not be covered by that because SALN is an instrument of transparency,\u201d he said.<\/p>\n<p>The CSC official said that it was necessary for all government personnel to show how they accumulated their wealth.<\/p>\n<p>\u201c<em>Dapat walang itinatago diyan<\/em>\u00a0(They should not be hiding anything).\u00a0<em>Dapat we are ready to show the people how we accumulate our wealth while we are working in government. Para sa kaalaman ng lahat na hindi natin ginagamit ang ating position to unlawfully enrich ourselves<\/em>\u00a0(This is to let everyone know that we\u2019re not using our position to unlawfully enrich ourselves),\u201d the CSC official said.<\/p>\n<p>\u201cWe have to remind them that these are instruments of transparency and therefore should be made available for inspection upon lawful request.<\/p>\n<p><strong>Should be probed<\/strong><\/p>\n<p>Ronquillo, however, said that the shading of portions of the SALN cannot be immediately attributed to the cabinet members\u2019 doing.<\/p>\n<p>\u201c<em>We cannot attribute that automatically to the filer kasi\u00a0hindi naman sila ang nag shade As far as they are concerned, nag-file sila ng SALN na kumpleto. Kung shinade yun ng iba baka hindi natin pwedeng sabihin na kasalanan nila yun automatically<\/em>\u00a0(We cannot attribute that automatically to the filer because they were not the ones who shaded it. As far as they are concerned, they filed their complete SALNs but they were shaded by someone else and that we cannot automatically conclude that they are at fault),\u201d Ronquillo said.<\/p>\n<p>He said there is a need to find out who performed the shading of portions of the SALNs.<\/p>\n<p>&#8220;<em>Kailangan maimbestigahan kung sino yung nag-shade<\/em>\u00a0(There needs to be a probe on who did the shading). At this point we cannot make a conclusion without the conduct of an investigation,\u201d Ronquillo said.<\/p>\n<p>Based on the SALN guidelines, Ronquillo said that the Commission checks whether the declaration is complete and is its proper form.<\/p>\n<p>\u201c<em>Kung nai-file nila yung tamang SALN, walang misinterpretation, walang in-omit, then wala tayong pwedeng sabihin na kasalanan nila automatically<\/em>\u00a0(If the SALN was filed correctly, without misrepresentation, without omissions, then we cannot say that it\u2019s their fault automatically),\u201d he added.<\/p>\n<p>He said that it was also worthwhile to determine how the other agencies worked.<\/p>\n<p>\u201c<em>Hindi natin alam kung ano naging kalakaran nila dun sa ahensiya nila. Kasi merong hierarchy of positions. Yung mga nasa lower positions taking orders from the top. Pero wala po tayong idea kung anong nangyari doon<\/em>\u00a0(We don\u2019t know how it works in those agencies. Because we have what we call a hierarchy of positions. Those in lower positions taking orders from the top. But we have no idea what is happening there),&#8221; he added.<\/p>\n<p>At present, he said that he has not received any reports of complaints filed against the Cabinet members.<\/p>\n<p><strong>No jurisdiction<\/strong><\/p>\n<p>Ronquillo, however, said that the CSC does not have jurisdiction to mete out disciplinary action against Cabinet members.<\/p>\n<p>\u201cThe problem is that the jurisdiction of the Civil Service Commission is limited to non-presidential appointees, so the ones involved here are presidential appointees. They are beyond our jurisdiction. Maybe they can refer it to an agency that has jurisdiction,\u201d Ronquillo said.<\/p>\n<p>\u201cIf there are any complaints it might be referred to the proper office which has disciplinary jurisdiction over them.
