Firstly, the charges alleged are false. Secondly, they do not constitute acts which the Constitution provides for impeachment,\u201d Poblador said.<\/p>\n<p>Poblador explained the allegations are not based on personal knowledge or authentic records, but on \u201chearsay\u201d derived from news reports or articles.<\/p>\n<p>He said that while there are certified true copies of relevant documents procured from the SC, these documents do not necessarily support or substantiate the allegations made in the complaint.<\/p>\n<p>He called on the House justice committee to accord Sereno the full exercise of her rights.<\/p>\n<p>\u201cBecause impeachment proceedings are analogous to criminal proceedings, it is our hope that the House committee will accord the Chief Justice full exercise of her rights to be heard by counsel and to confront the witnesses in the complaint by cross-examination,\u201d Poblador said.<\/p>\n<p>The verified answer cautioned the House not to abuse its judicial power of impeachment by deciding without any sufficient legal and factual basis.<\/p>\n<p>\u201cIf the grounds for impeachment of the Chief Justice can be trivialized to include any grounds which Congress may consider, the fate of the Judiciary would be subjected to the whims of Congress,\u201d the answer read.<\/p>\n<p>\u201c[The abuse of power by the legislative] would in effect place a co-equal branch at its mercy and imperil the very existence of our democratic form of government&#8211;a government which rests on the principle of independence and equality of the three great branches of government,\u201d it added.<\/p>\n<p>Poblador also urged justice panel members, as sitting judges for the determination of probable cause, to decide on the basis of facts and law \u201cand not on the dictates of their political leaders in line with some political agenda.\u201d<\/p>\n<p>The justice panel has found the Gadon complaint as sufficient in both form and substance in a 30-4 vote.<\/p>\n<p>In his complaint, Gadon accused Sereno of culpable violation of the Constitution, corruption, other high crimes and betrayal of public trust.<\/p>\n<p>Gadon stated that Sereno did not declare in her Statement of Assets, Liabilities and Net Worth (SALN) the \u201cexorbitant lawyer\u2019s fees\u201d of USD745,000 or PHP37 million which she received from the Philippine government.\u00a0<em><strong>(PNA)<\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>MANILA\u00a0 \u2014 The legal team of the Supreme Court (SC) Chief Justice Maria Lourdes Sereno on Monday filed her verified &hellip;<\/p>\n","protected":false},"author":33,"featured_media":113989,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[16,95],"tags":[7200],"class_list":["post-119321","post","type-post","status-publish","format-standard","has-post-thumbnail","category-news","category-news-ph","tag-sereno","mauthors-filane-mikee-cervantes","mauthors-philippine-news-agency"],"_links":{"self":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts\/119321","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/users\/33"}],"replies":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/comments?post=119321"}],"version-history":[{"count":0,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/posts\/119321\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/media\/113989"}],"wp:attachment":[{"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/media?parent=119321"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/categories?post=119321"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/canadianinquirer.net\/v1\/wp-json\/wp\/v2\/tags?post=119321"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
