Duterte signs EO ending contractulaization on Labor Day

President Rodrigo Duterte on May 1, Labor Day, signed an executive order that would put end to illegal contractualization, but this may not be enough as he said Congress needs to amend labor code to have this arrangement fully effective.

“I remain firm in my commitment to put an end to endo and illegal contractualization,” Duterte on Tuesday said in Cebu City.

He adds, “However, I believe that in order to implement an effective and lasting solution to the problems brought about by contractualization, Congress needs to enact a law amending the labor code.”

The EO prohibits “illegal contracting and sub-contracting or undertaking to circumvent the workers’ right to security of tenure,” the president, reading the order, said.

The security of tenure refers to the “right of employees not to be dismissed or removed without a just and authorized cause and observance of procedural due process pursuant with the Constitution and Labor Code.”

The need for Congress to come up with a new labor code should be set as the current one is “outdated,” Duterte said, adding that it should be revised to address the realities of today.
