Sereno appeals SC’s ruling to oust her

Former Chief Justice Ma. Lourdes Sereno urged the high tribunal to reverse its May 11 decision favoring the quo warranto case that led to her ouster.

The ex-chief magistrate issued a 203- page motion for reconsideration before the Supreme Court (SC) on Wednesday.

In her MR, Sereno said: “In accordance with letter and spirit of Section 2, Article XI of the Constitution, this Honorable Court had consistently held in a long line of jurisprudence, that impeachable officers, especially Members of the Supreme Court, could be removed only by impeachment.”

“Now an impeachable officer may also be ousted via quo warranto”, she added.

Sereno also said that the six magistrates who voted against her were supposed to be disqualified as they were showing bias against her, thus losing their impartiality to hear and decide her case. She insisted that excluding them in the deliberation of the quo warranto case is a “right and just thing to do” for the SC.

Sereno stated that if the decision of the high court remains, then it means that the rise of denying an individual’s right to due process is really happening.

“The Decision illustrates vividly the dire and far-reaching consequences of a denial of due process,” Sereno said.
