DMCI asking for damages from NCCA

MANILA — The DMCI, the contractor of Torre de Manila, is asking for damages from the National Commission on Culture and the Arts (NCCA).

Torre de Manila is accused of being the so-called “photobomber” of Rizal Monument in Luneta Park, Manila.

According to Atty. Roberto Dio, counsel of DMCI, they have questioned before the Makati City Regional Trial Court (RTC) the action of the the NCCA in issuing a “cease-and-desist” order against Torre de Manila.

Dio said that it was not within the power of the NCCA to stop the construction of Torre de Manila.

Aside from that, Dio said, it was also possible that the issuance of the cease-and-desist order was only the decision of the chairman of NCCA and it was known by the entire board of NCCA.

Although they have already filed a petition before the Makati City RTC seeking to nullify the cease-and-desist order, Dio said, the NCCA has not yet filed a reply in their case.

The oral arguments in the case of Torre de Manila before the Supreme Court (SC) will resume on Tuesday.

The SC earlier issued a temporary restraining order (TRO) against the construction of Torre de Manila last June.
