Napoles’ final affidavit submitted to DOJ

MANILA — The final and complete affidavit of Janet Lim Napoles in connection with her transactions with certain lawmakers about the alleged misuse of the Priority Development Assistance Fund (PDAF) was submitted by her lawyers to the Department of Justice (DOJ) on Monday.

Napoles is the alleged “brains” behind the P10-billion pork barrel and the P900-million Malampaya Fund scams.

According to Atty. Bruce Rivera, counsel of Napoles, also included in her affidavit is her request to be placed under the government’s Witness Protection Program (WPP).

However, Rivera refused to disclose the details of the affidavit because of fear that by doing so may jeopardize her request to be a state witness because the WPP is covered by “confidentiality rule.”

On the other hand, Rivera confirmed that aside from the list they earlier submitted to the DOJ, there were new names of lawmakers included in the document.

The affidavit, notarized and signed by Napoles, consists of more than 30 pages.

The pieces of documentary evidence in the possession of Napoles were not among those turned over to the DOJ on Monday.

The camp of Napoles said they expect the DOJ to submit the copy of the affidavit before the Office of the Ombudsman who has the authority to determine who should be granted immunity from criminal prosecution as state witness.

Rivera believes that Napoles is not the “least guilty” in the crime, but she is also not the “most guilty.”

Rivera earlier said that the affidavit and list would reveal the entire truth about the pork barrel scam.
