On Wednesday, the Bureau of Internal Revenue (BIR) filed several criminal charges involving falsification of public documents, versus ‘La Luna Sangre’ actor Richard Gutierrez, at the Department of Justice (DOJ).

BIR sued Gutierrez for violating National Internal Revenue Code (NIRC) specifically, with one count of submission of falsified annual income tax return, six counts of submissions of falsified quarterly value-added tax (VAT) returns as violations to Article 172 of the Revised Penal Code in relation to Article 171 of the same code.

Plus, a violation of Article 183 of the Revised Penal Code with two counts of submission of perjured affidavits.

Allegedly, Gutierrez is guilty of four counts of making it appear that his annual Income Tax Return and quarterly VAT returns are filed by his representative – a violation of Section 255 of the NIRC of 1997, as amended.

BIR filed these cases against Gutierrez’s response in April this year; in which the now-Kapamilya actor was also involved in another tax evation case.

Based on BIR’s complaint at the DOJ then, Gutierrez and his production company, R Gutz Production Corporation allegedly failed to submit income tax returns and pay income tax in 2012, owing the government a total of P38.57 million including surcharges and VAT.

On July, Gutierrez filed his counter-affidavit. In an interview with Sunstar after, his lawyer Marie Glen Abraham-Garduque said “If you will compute the taxes filed by R Gutz for the year 2012, it covers the whole 39 million that was allegedly underdeclared.”
