Napoles asks SC to void her plunder raps
MANILA — Alleged pork barrel scam “brains” Janet Lim Napoles has questioned before the Supreme Court (SC) the ruling of the Office of the Ombudsman indicting her and other accused for plunder and graft in connection with the P10-billion Priority Development Assistance Fund (PDAF) misuse.
Napoles asked the SC to nullify the case against her in connection with the PDAF scam.
This was through three separate petitions for certiorari filed by the camp of Napoles before the SC.
Napoles is a co-accused of Senators Juan Ponce Enrile, Jose “Jinggoy” Estrada and Ramon “Bong” Revilla Jr.
in the plunder and graft charges pending before the Sandiganbayan.
In her petition, Napoles argued that grave abuse of discretion was committed on the part of the Ombudsman when she was charged with plunder and graft before the Sandiganbayan in connection with the pork barrel scam.
She said that the Ombudsman ruled that there was “probable cause” in the complaint against her despite the lack of element of “ill-gotten wealth.”
The petitioner added that the Ombudsman failed to present sufficient basis to prove the case of violation of the Anti-Graft Law.
Napoles further argued that she was not involved in the fake Non-Governmental Organizations (NGOs) which were discovered by the Ombudsman that were allegedly allotted with the PDAF of some lawmakers.
Hence, she asked the SC to quash the information filed by the Ombudsman and recall the issuance of the arrest warrant against her.
