Sandiganbayan junks Enrile’s motion to dismiss plunder raps
MANILA — The Sandiganbayan junked the motion to dismiss the plunder cases of Senator Juan Ponce Enrile for his alleged involvement in the pork barrel scam.
“It has been held that while it is fundamental that every element of the offense must be alleged in the information, matters of evidence… need not be averred,” the resolution said.
The motion which indicated that the charges against Enrile was not clear was dismissed by the 3rd Division, chaired by Presiding Justice Amparo Cabotaje-Tang.
Enrile’s motion to bail was also earlier dismissed by the anti-graft court.
Sandiganbayan insisted that Enrile may have overlooked that he was charged with a capital offense.
Enrile is also currently facing 15 counts of graft charges before the Sandiganbayan, aside from the plunder cases he is currently on.
The senator is now being held by the Philippine National Police Custodial Center in Camp Crame.
